In the case of Pittsburgh Steelers Sports, Inc. v. Workers’ Compensation Appeal Board (Trucks), Tom Baumann argued that Mr. Trucks signed a yearly contract with the Steelers and as a year-round employee was required to perform year-round obligations for the team. Therefore, Mr. Trucks workers’ compensation benefits should be based upon the contract he signed.

The conversion would put a limit on how long workers could receive wage loss benefits. In the landmark case of Protz v. WCAB, Abes Baumann’s attorneys successfully convinced the Pennsylvania Supreme Court that the delegation to the AMA constituted an unconstitutional delegation of authority. The Act was therefore voided.

Wilkie. This case involved the claim of Alfred Procopio a veteran of the U.S. Navy who served in waters off Vietnam and sought service-connected compensation for prostate cancer and diabetes, two conditions that the VA has found are caused by exposure to Agent Orange. Mr. Procopio’s claim was denied by the VA as he did not set foot on land in Vietnam. He was considered a Blue Water vet and, by VA definition, ineligible for benefits for diseases caused by Agent Orange.

At a continuing legal education seminar on October 9, 2017, Mr. Baumann was the sole speaker at a Seminar entitled "Protz v. WCAB--The Art of the Possible." The purpose of the seminar was to inform Western Pennsylvania attorneys about  the implications of the landmark Pennsylvania Supreme Court decision in Protz v. WCAB. In this case the Supreme Court determined that a portion of the Pennsylvania Workers' Compensation Act was in fact unconstitutional. This has been a very important development that has positively affected the lives of many injured workers' who receive workers' compensation in Pennsylvania. Mr. Baumann was the injured workers' attorney in the Protz case. Mr. Baumann was warmly received by the many attorneys present and thanked the Association for the opportunity to speak before it. Abes Baumann attorneys are well-versed in the legal ramifications of the Protz decision.
